Combs Waterkotte represented an Overland man on one count of domestic assault in the second degree in St. Louis County Circuit Court. The victim expressed her desire not to participate in the prosecution of the defendant early in the case. However, the prosecution initially refused to dismiss the case believing they could still obtain a conviction even without the alleged victim’s testimony because two police officers allegedly witnessed the defendant choke and slam his girlfriend to the ground and would testify accordingly. We prepared the case for trial and on the day of trial, the prosecution announced it was DISMISSING the charge against our client.
