Combs Waterkotte represented a 17 year old St. Peter’s resident who was charged with burglary, a class C felony, which carries a maximum penalty of up to 7 years in prison. The state alleged that our client along with two other individuals broke into a home and stole more than $3,000 in cash and goods. One of our client’s alleged accomplices was not criminally charged in exchange for his testimony against our client. The other co-defendant, who was represented by another attorney, had already pled guilty. Despite the fact that the cooperating witness admitted to breaking into the home with our client, we were able to thoroughly discredit his testimony at the preliminary hearing. The judge did not find probable cause and DISMISSED the case.
