What Are the Different Levels of the Sex Offender Registry in Missouri?
Sex crime charges can change your life, and a conviction can carry some of the most severe penalties the state allows. In Missouri, sex offenders are classified into three different tiers or levels based on the severity of the offense. These tiers help determine the length and frequency of registration requirements.
Missouri Revised Statute § 589.414 outlines the tiers. Here’s a breakdown:
Tier I
This is the lowest level of classification and typically includes less severe sex crimes. Offenders in this tier are required to register for 15 years, unless the following conditions are met:
- Have not committed any crimes resulting in imprisonment of a year or more
- Have not committed any sexual crimes
- Have successfully completed a period of supervised release, probation, or parole
- Have successfully completed a sex offender treatment program
If those terms have been met, offenders can be removed after 10 years. Offenders must report once a year to the Chief Law Enforcement Officer (CLEO) to verify their registration information – personal information, addresses (home, work, school), phone numbers, internet identifiers (email), identification, DNA sample, fingerprints and palm prints, employment, and vehicle information.
Tier I Offenses may include:
- Sexual Abuse in the First Degree
- Certain Instances of Sexual Misconduct
- Kidnapping in the Second or Third Degree
- Promoting Obscenity to Minors
Tier II
Tier II includes more serious offenses, and offenders must register for 25 years and verify their registration with the CLEO every 6 months. Offenses include:
- Promoting Child Pornography
- Enticing a Child for Sexual Activity
- Sexual Exploitation of a Minor
- Statutory Sodomy in the Second Degree
Tier III
This is the highest and most severe classification, reserved for the most dangerous or repetitive offenders referred to as predatory or persistent sexual offenders. Tier III offenders must register for life, and are required to verify their registration every 90 days.
