Combs Waterkotte represented a college student on a DWI charge. During the administrative hearing, which deals with license suspension, we challenged the arresting officer’s failure to properly observe our client for the required 15 minutes prior to our client submitting to the breathalyzer. Accordingly, the Missouri Department of Revenue rescinded our client’s suspension. As a result, our client did not suffer any license loss as a result of her DWI despite a BAC result nearly two times the legal limit. Additionally, due to several officer errors during the field sobriety test, the prosecutor decided to dismiss the criminal case against our client.
